Convicted of kidnapping contrary to § 40A-4-1, N.M.S.A. 1953 (2d Repl. Vol. 6, 1972, Supp.1973) and aggravated assault upon a peace officer contrary to § 40A-22-21, N.M.S.A. 1953 (2d Repl. Vol. 6, 1972) defendant appeals asserting five points for reversal: (1) prosecutors comment on defendants silence; (2) insanity as a matter of law; (3) change of venue; (4) evidence would not sustain conviction of kidnapping; and, (5) failure to quash indictment on assault charge. We affirm.
